Terms of Service

Article 1 (Purpose)

These Terms of Service set forth the rights, obligations, and responsibilities of the Company (the "Company") and its members, as well as other necessary matters, regarding the use of the WORKY service (the "Service") provided by the Company.

"Member" means any user (individual members and business/store-owner members) who agrees to these Terms and uses the WORKY Service.

Article 2 (Effect and Amendment of the Terms)

These Terms take effect for all members who wish to use the Service. The Company may amend these Terms to the extent that such amendment does not violate applicable laws, and the amended Terms take effect upon notice within the app. Important changes affecting members' rights and obligations will be announced in advance. If a member continues to use the Service after the effective date of the amended Terms without expressing refusal, the member is deemed to have agreed to the amended Terms.

Article 3 (Other Rules)

These Terms apply together with the usage guides for individual services provided by the Company. Matters not specified in these Terms are governed by applicable laws and the purpose of each service guide.

Article 4 (Definitions)

1. "Individual member" means a member who uses services such as job seeking, community, and chat.

2. "Business (store owner) member" means a member who uses the Service for business purposes, such as posting job openings.

3. "Post" means any information posted by a member on the Service, including posts, comments, photos, chat messages, job postings, and product information.

Article 5 (Formation of the Use Agreement)

The use agreement is formed when a member agrees to these Terms and applies for use, and the Company accepts the application. For business (store owner) members, use of the Service may commence after the Company's approval (screening) process.

Article 6 (Application for Use)

1. A member who wishes to use the Service must truthfully provide the information requested by the Company (name, contact information, email, etc.).

2. A member who signs up using another person's identity (name, contact information, etc.) may be punished under applicable laws, and their use of the Service may be restricted.

Article 7 (Provision and Change of the Service)

The Company provides services such as job matching (posting and applying for job openings), community, and chat. The Company may change the Service after announcing the details and the date of the change through the app.

Article 8 (The Company's Position on Transactions and Hiring Between Members)

1. The Company is an online platform provider, acting as an intermediary and information provider for job matching (hiring) between members, and is not a party to any employment contract or transaction between members.

2. Responsibility for hiring processes, working conditions, product quality/condition, and the performance of transactions between members lies with the relevant members, and the Company assumes no responsibility therefor.

3. The Company does not guarantee the accuracy, reliability, or legality of job postings, products, or posts published by members. Users are responsible for verifying such information sufficiently before making a transaction or application.

Article 9 (Protection of Personal Information)

The Company protects members' personal information in accordance with applicable laws and the Company's Privacy Policy. Matters concerning the collection, use, storage, and destruction of personal information are governed by the Privacy Policy.

Article 10 (Service Hours)

1. In principle, the Service is available 24 hours a day, year-round, unless there is a special business or technical impediment. However, the Service may be temporarily suspended when necessary, such as for system inspection, expansion, or replacement, and scheduled maintenance will be announced in advance.

2. The Company may temporarily suspend the Service without prior notice in unavoidable circumstances such as urgent maintenance.

3. The Company may restrict or suspend all or part of the Service if normal provision of the Service is difficult due to a national emergency, power outage, equipment failure, excessive usage, or similar circumstances.

Article 11 (Member ID and Account Management)

1. Members are responsible for managing their account (ID) and password.

2. Members are responsible for any consequences arising from negligent management of their account or password or from unauthorized use by third parties.

Article 12 (Management of Posts)

The Company may delete or move any post (including chat messages) falling under any of the following, or refuse its registration, without prior notice, and may restrict the use of the Service by the violating member.

1. Content that insults, defames, or damages the reputation of another member or a third party

2. Content that violates public order and good morals (obscenity, violence, hate, etc.)

3. Content connected to illegal copying, hacking, or crime

4. Unauthorized advertising or spam for commercial purposes

5. Content that infringes the copyright or other rights of others

6. Content that deceives users, such as fake job postings or fake listings

7. Any other content deemed to violate applicable laws or Company policies

Article 13 (Copyright of Posts)

1. The copyright of a post belongs to the member who posted it. The member who posted content that infringes a third party's rights bears responsibility for such infringement.

2. The Company may use posts within the scope of operating, displaying, and promoting the Service; commercial use beyond this scope requires the poster's consent.

3. Members may not process, sell, or use information obtained through the Service for commercial purposes without the Company's consent.

Article 14 (Reporting and Restriction of Use)

If a violation of these Terms or applicable laws is confirmed through a member's report or the Company's own monitoring, the Company may take measures such as deleting posts, restricting chat or posting, suspending use, or revoking membership.

Article 15 (Provision of Information and Advertising)

1. The Company may provide members with various information related to the operation of the Service via in-app screens, push notifications, email, etc.

2. The Company may display advertisements on Service screens. Any transaction between a member and an advertiser is solely a matter between the member and the advertiser, and the Company assumes no responsibility therefor.

Article 16 (Termination and Refunds)

A member who wishes to terminate the use agreement may do so through the in-app account deletion procedure. Refunds for paid services are governed by applicable laws and the standard terms of the Korea Fair Trade Commission.

Article 17 (Compensation for Damages)

If a member suffers damage due to the Service provided by the Company, the Company is liable only for ordinary damages and only where such damage was caused by the Company's willful misconduct or gross negligence.

Article 18 (Disclaimer)

1. The Company is exempt from liability if it cannot provide the Service due to force majeure such as natural disasters or war.

2. The Company is exempt from liability for damages caused by the suspension of telecommunication services by telecommunications carriers.

3. The Company is not liable for Service disruptions or damages attributable to the member.

4. The Company is not liable for transactions or hiring between members, the reliability or accuracy of information posted by members, or any profit a member expected to gain through the Service.

5. The Company is not liable to compensate for emotional or financial damage suffered by a member because of another member.

※ Matters not stipulated in these Terms are governed by applicable laws and general commercial practice.
